Terms of Service

These terms govern your use of funeralwiseai.com and the FuneralWiseAI assistant. FuneralWiseAI is a product of ChurchWiseAI LTD, a Canadian corporation operating as WiseAI Agency.

By subscribing to or using the service, you agree to them. If you are agreeing on behalf of a funeral home, you confirm you are authorised to do so.

1.The agreement

This agreement is between you — the funeral home — and ChurchWiseAI LTD. If we change these terms materially, we will give notice by email before the change takes effect. Continuing to use the service after that is acceptance.

2.What FuneralWiseAI is not

FuneralWiseAI answers your phone and your messages. It does not practise your profession, and it never claims to.

  • It is not a funeral director, and it does not give funeral, legal, or financial advice.
  • It is not a grief counsellor, a therapist, or a member of the clergy.
  • It does not quote a final price or enter into a contract on the home’s behalf.

The assistant identifies itself as an AI and is designed around one rule: AI is a bridge to people, never a replacement for them. Its purpose is to capture what matters and get a human involved quickly.

3.The service

We provide an AI assistant that answers calls and messages, captures enquiries, and passes them to you — together with a dashboard for reading transcripts and managing what the assistant knows.

We aim for continuous availability but do not guarantee uninterrupted service. The assistant depends on telephony, speech, and language-model providers we do not control. You should keep a way for people to reach you if the assistant is unavailable.

4.Your obligations

  • Give the assistant accurate information. What it tells callers about your hours, your services, and your prices comes from you.
  • Monitor what comes in. The assistant captures enquiries; acting on them is yours.
  • Keep a human path available for anyone who wants one, and for urgent situations.
  • Meet the notice and consent requirements that apply where you operate, including for call recording if you enable it.
  • Keep your dashboard access secure and control who on your team has it.

5.Sector-specific responsibility

In the United States, the FTC Funeral Rule governs how prices are disclosed over the telephone. The assistant is configured to give the price information the funeral home supplies and to hand the call to staff for anything beyond it. The funeral home remains responsible for the accuracy of the prices and disclosures it supplies, and for its own compliance with the Funeral Rule and any equivalent provincial or state requirement.

6.Acceptable use

You may not use the service to:

  • Break the law, or help anyone else to.
  • Present the assistant as a human being, or strip out its disclosure that it is an AI.
  • Configure it to give professional advice it is not qualified to give, or to discourage someone from seeking a person.
  • Attempt to extract another customer’s data, or to probe or disrupt the system.
  • Resell or white-label the service without a written agreement with us.

We may suspend an account that does any of these, and we will tell you why.

7.The limits of an AI assistant

An AI assistant can misunderstand a caller, mis-hear a name or a number, or answer from out-of-date information you supplied. It is a tool for capture and triage-to-a-human, not a substitute for your judgement.

Where a conversation suggests real distress or an emergency, the assistant is built to stop trying to help and point to a person or an emergency service instead. You must not configure it to do otherwise.

8.Fees and billing

Current pricing is on the pricing page at funeralwiseai.com/pricing. We deliberately do not restate the numbers here, so that this page cannot fall out of step with them.

Subscriptions bill in advance and renew automatically until cancelled. Setup fees are one-time and non-refundable once setup work has begun. You can cancel at any time and keep access to the end of the paid period. Billing records are kept for seven years, as Canadian and US tax law requires.

9.Intellectual property

We own the software, the assistant’s design, and the FuneralWiseAI name and marks. You own your content — your knowledge base, your recordings and transcripts, your contacts and configuration — and you keep ownership of it. You grant us only the licence needed to run the service for you.

10.Liability

The service is provided as-is. To the fullest extent the law allows, our total liability for any claim is limited to the fees you paid in the twelve months before the claim, and we are not liable for indirect or consequential losses, including lost business.

Nothing here limits liability that cannot be limited by law. Some jurisdictions do not allow these exclusions, in which case they apply only as far as permitted.

11.Termination

You may cancel at any time. We may terminate for non-payment or for a breach of the acceptable-use section, with notice where circumstances allow. On termination you can export your data; we keep it for 90 days after the subscription ends so an account can be reactivated, then delete it. You can ask for earlier deletion at privacy@churchwiseai.com.

12.Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction.
